What Happened?
The NAR recently reached a settlement to resolve litigation concerning how real estate agent compensation is structured, specifically regarding offers of compensation to buyer’s agents. Historically, sellers often offered a commission to the buyer’s agent as part of the MLS (Multiple Listing Service) listing. Under the new settlement, this practice will change.
Key Changes to Know:

Offers of compensation will no longer be displayed on MLS platforms. Sellers can still choose to offer compensation to a buyer’s agent, but it must be communicated outside of the MLS system.

Buyer representation agreements will be required. Buyers will now sign formal agreements with their agent that clearly outline how their agent will be compensated, typically before touring homes.

More transparent negotiations. Buyer’s agent compensation is now an open point of negotiation between the buyer, seller, and their respective agents.
